Good News / Bad News

Well, OK, I don’t know if this is really bad news — at least, it shouldn’t be for employers who are careful about staying on the right side of wage and hour law. But anyway, apparently just last week Florida’s Miami-Dade County became the first county in the U.S. to pass an ordinance to combat wage theft. The ordinance reportedly establishes a low-cost streamlined process to make it easier for workers to sue employers who try to stiff them out of overtime pay.

As if that weren’t enough, the employee-side law firm of Morgan & Morgan, with offices nationwide, has announced the launch of USOvertimeLawyers.com, featuring articles, frequently asked questions and an overtime calculator to help employees figure the amount of overtime they should be paid. They even offer a free evaluation by a lawyer to employees who think they might have been underpaid. Ya know, it’s getting harder and harder for unscrupulous employers to rely on employee ignorance of overtime law to help them get away with wage theft… which in the long run, is probably a good thing, both for employees and for those employers who play by the rules.

In a move that was definitely good news for employers, not one but two judges have ruled the treble-damages portion of Massachusetts’ tip law was NOT intended to be applied retroactively. I know there are some Bay State employers who are breathing a sigh of relief over that one.
