The FLSA and the Flu

Well, so far it seems the H1N1 flu isn’t turning out to be the unmitigated public health disaster that some originally predicted, but the “P” word (pandemic) is still being tossed about.
So the US DOL has issued Pandemic Flu and the Fair Labor Standards Act: Questions and Answers, a PDF-format document that lets employers know some of their options should we find ourselves facing a pandemic situation.
In the event of an actual pandemic (flu or otherwise), you might find yourself coming up short on employees, or looking for alternative work arrangements — such as telecommuting or staggered shifts — to help keep employees from getting sick. Problem is, these situations also have implications for how you track employee time and attendance and pay wages under the Fair Labor Standards Act. Imagine what a bummer it would be to find out the things you’re doing to try to keep your business going or keep your employees healthy are making you liable for wage and hour penalties and fines — or even a lawsuit or two.
