Quirky Questions on Overtime

From the HR Daily Advisor comes two useful posts answering a number of tricky questions about overtime.

The first post covers interesting questions such as:

  • Do I have to count paid lunch periods when calculating hours worked for overtime?
  • What about paid breaks?
  • Does it make a difference if they’re smoke breaks?
  • How do you calculate overtime for salaried nonexempt employees who work over 40 hours a week?

The second post addresses these thorny issues:

  • Do I have to pay overtime to employees who clock in early?
  • Do I have to count bonuses when calculating the employees’ “regular rate of pay” for overtime purposes?
  • Do I have to use a time clock?

Interesting stuff! And their recommendation to conduct a wage and hour audit yourself to make sure your house is in order before the DOL shows up at your door is an excellent one.
