Six Steps to Avoid Wage and Hour Lawsuits
Posted on 26-Nov-07 by The Timekeeper
Check out the great advice in this article from the Rush on Business blog: Tips on How to Avoid Wage & Hour Lawsuits.
The tips may sound to many like nothing more than good common sense. But let me tell ya, I come across reports of violations of these basic rules almost every day. What’s sad is how much money it costs the small businesses who violate the law, and how simple it would have been to prevent.
Trust me, this is not a situation in which you want to find yourself.
So even if you think you’re just fine, read and implement his tips. You may be surprised… but better to have a small (easily correctable) “oopsie” now than a large and expensive shock on down the road.
One thing related to his first tip… he says to get with an employment law attorney or other wage and hour specialist to conduct a wage and hour review. Excellent tip. While you can certainly consult with any qualified specialist to develop your overall compliance program, when it comes to the actual audit you might want to ponder this bit of advice I ran across recently, and consider hiring a lawyer for the audit itself so as to maintain attorney-client privilege about the results. Just a thought.
Oh, yeah, and I agree with one of the comments following the blog post — an additional tip is to make sure you’re in compliance with your state laws, as well, because they may be more stringent than federal mandates. Staying out of trouble with the feds is great — staying out of trouble with the feds and your state is even better.

Great point on the wage and hour audit. It’s sound advice to have an attorney do the audit. I plan to update my post with your comments.
