Are Your Employees Properly Classified?

From what I’ve seen, one of the largest categories of wage & hour settlements and fines is that of employees who have been misclassified as exempt (and thus, not paid overtime), when they were actually non-exempt.
When the exemptions in the Fair Labor Standards Act were updated back in 2004, the smart employers paid close attention. But now, nearly three years later, attention may have waned a bit. This is unfortunately, and potentially dangerous — all it takes is one employee complaint to bring your entire company’s classification system under DOL review!
When it comes to ensuring your employees are classified correctly, your best bet is to consult with a qualified professional — especially if there are any who fall into a “gray area.” However, a good start might be to review this list of common exemptions on the DOL website.
A few minutes reviewing and verifying your employee classifications could save you thousands of dollars on down the line!
